A federal judge has dismissed a case filed by a man who argued that his appearance as a nude infant on the cover of Nirvana's 1991 album constituted child sexual abuse imagery. The photo, showing Spencer Elden at four months old, became an iconic symbol of the band's landmark album "Nevermind." In his ruling, Judge Fernando Olguin of the U.S. District Court for the Central District of California determined the cover does not qualify as child sex abuse material. He stated that "the pose, focal point, setting nor overall context" indicate sexually explicit conduct, and noted that aside from Elden's nudity, nothing about the image approaches the legal definition of child pornography — comparing it instead to an innocent family photo of a child in a bath. Judge Olguin further observed that Elden's own behavior seemed inconsistent with his claim of harm. Elden had profited from his association with the album, the judge noted, by accepting payment to recreate the photo, selling autographed posters and memorabilia, and publicly identifying as the "Nirvana baby." The judge also pointed out that Elden has the album's name tattooed on his chest. The win for Nirvana was the culmination of a legal battle lasting more than four years. Mr. Elden had filed his lawsuit against the estate of Kurt Cobain, Nirvana’s lead singer; the former band members Dave Grohl and Krist Novoselic; and Mr. Cobain’s widow, Courtney Love, among other parties. dismiss a case — прекратить производство по делу
